Rule Making Deadlines

The 2021 Legislative session will start 1 month later than usual due to the inauguration. Therefore, rule-making deadlines are also 1 month later. For a rule to be considered during the 2021 session, it must be put out for public comment by Wednesday, July 29, 2020. Agency Approved filings must be made by 5:00 pm on Friday, August 28, 2020.

The deadline dates for the 2022 Legislative session are Wednesday, June 30, 2021 to put a rule out for public comment and Friday, July 30, 2021 for Agency Approved filings.

State of Emergency Suspension of Certain Rules


Due to the outbreak of the COVID-19 virus, a State of Emergency was declared for all counties in West Virginia on March 16, 2020. The Proclamation contained a provision allowing state agencies the ability to suspend rules, if strict compliance would prevent or delay necessary action in coping with the emergency.

Rules that are suspended wholly or in part will have a status of “Suspended” in the CSR database. There will also be a suspension memorandum from the Agency explaining the details. Please follow all guidelines given by the Agency.

As the keeper of the Governor’s official papers, there are many documents filed here. Aside from Executive Orders, Proclamations, and Appointments of State Officials there are some miscellaneous records as well.

Each year, the Secretary of State’s office sends reminders to each of the County Commissions in West Virginia reminding them of the requirement to send a list of the Public Service Districts located in their county. Those lists and many other records are available in the Executive Records Search.
